GENERAL RELEASE AND ASSUMPTION OF RISK PLEASE ONLY VISIT THE FIGHT FACTORY GYM IF THE FOLLOWING APPLY: You are willing to practice social distancing and maintaining at least six feet between individuals in all areas of the gym; (2) You are healthy enough to participate, and do not have symptoms of COVID 19 such as feeling sick, coughing, sneezing, shortness of breath, fever or are not feeling well; (3) You do not live with and have not visited a person or family member that has been diagnosed with or suspected of having COVID-19; (4) You consent to having your (or your minor child’s) temperature checked upon entering the gym.
I certify and acknowledge that I have full authority as parent or legal guardian of the minor participant listed below to bind the minor participant to this agreement.
(1) ASSUMPTION OF RISK AND RELEASE OF LIABILITY: I, on behalf of myself and my minor child, acknowledge and agree that we are voluntarily participating in the gym activities, which I agree are dangerous and entail both known and unknown inherent risks, including the risk of injury, permanent disability or death, and I hereby voluntarily assume all such risks. Despite all known and unknown risks, I, on behalf of myself, my spouse and my minor child, hereby expressly, unconditionally and voluntarily release and forever discharge, and agree not to sue, the Fight Factory Gym, its officers, officials, agents and/or employees, as well as other participants, sponsoring agencies, sponsors, advertisers, owners, parent companies, affiliated entities and lessors of premises (collectively the “Releasees”), and agree to hold Releasees harmless of and from any and all manner of actions or omission(s), causes of action, suits, sums of money, controversies, damages, judgments, executions, claims and demands whatsoever, in law or in equity, including, but not limited to, any and all claims which allege negligent acts and/or omissions committed by the Releasees. I understand and agree that this Assumption of Risk and Release of Liability prohibits me or my spouse from filing a lawsuit against Fight Factory, even if I or my minor child suffers damage, loss, personal injury, emotional injury, or death and even if the damage, loss, personal injury, or death was caused by any act or omission of Releasees.
(2) ASSUMPTION OF RISK AND RELEASE OF LIABILITY FOR COMMUNICABLE DISEASES INCLUDING COVID-19: I, on behalf of myself and my minor child, acknowledge and agree to the following: (1) Presence in the gym, and participation in the gym’s activities, includes possible exposure to and illness from infectious diseases, including but not limited to MRSA, influenza, and COVID-19, which carries a risk of serious illness and death; (2) I (on behalf of myself and/or my minor child) knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of others, and assumes full responsibility for being present in the gym and/or participating in gym activities;
(3) I (on behalf of myself and/or my minor child) agree to comply with all rules and protocols for protection against infectious diseases, and, (4) I, on behalf of myself and my minor children, as well as on behalf of my spouse, heirs, assigns, personal representatives and next of kin, hereby release and hold harmless the Fight Factory Gym, its officers, officials, agents and/or employees, as well as other participants, sponsoring agencies, sponsors, advertisers, owners, parent companies, affiliated entities and lessors of premises (collectively the “Releasees”), with respect to any and all illness, disability, death, or loss or damage to person or property, whether arising from the negligence of Releasees or otherwise, to the fullest extent permitted by law.
(4) PHOTO RELEASE: By entering the Fight Factory, I, on behalf of myself, my spouse, and my minor child hereby grant the Fight Factory the irrevocable right and permission to photograph and record me, my spouse and/or my child in connection with the Fight Factory and to use the photograph or recording for all purposes, including advertising and promotional purposes, in any manner and all media now or hereafter known, in perpetuity throughout the world, without restriction as to alteration. I, on behalf of myself, my spouse, and my child, waive any right to inspect or approve the use of the photograph or recording, and acknowledge and agree that the rights granted by this release are without compensation of any kind.
(5) TERMS OF AGREEMENT: I understand that this agreement extends forever into the future and will have full force and legal effect each and every time I, my spouse, and/or my child enters the Fight Factory.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. You MUST be 18 years old or older to sign your own waiver You MUST be the Parent or Legal Guardian to sign for a minor (under age 18)
